We, the undersigned citizens of Utah, respectfully petition the Supreme Court for an expedited review of the case Lyman v. Cox. We believe the Utah Supreme Court's decision in this case undermines the principles of free and fair elections, and we urge the Court to act swiftly to address these concerns.
The outcome of the Utah Republican Party primary election for Governor is currently in dispute. The Utah Supreme Court ruled against Phil Lyman's claim that he should have been on the general ballot as the party's nominee. In contrast he was forced to a write-in candidate receiving 121,805 write-in votes (as of 11/13/2024) demonstrating substantial support among Utah voters. This decision raises serious questions regarding the fairness and integrity of the election process and the rights of political parties to conduct their internal affairs without undue state interference. We believe this decision conflicts with established legal precedents on the First Amendment rights of political parties.
The significant number of write-in votes for Mr. Lyman underscores the urgency of this matter. The delay in resolving this case leaves Utah voters in a state of uncertainty regarding the legitimacy of the election results and potentially harms the integrity of the upcoming general election.
Therefore, we urge the Supreme Court to expedite its review of this case and ensure a just and timely resolution. Utahns deserve free and fair elections, and the swift action of this Court is essential to protecting this fundamental right.
